By accessing or using Supascale ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Supascale is a software platform that enables users to deploy, manage, and maintain self-hosted Supabase instances on their own infrastructure. The Service includes:

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to:
Upon purchase, Supascale grants you a non-exclusive, non-transferable, perpetual license to use the software on servers you own and operate. This license includes one (1) year of software updates from the date of purchase.
All payments are processed securely through Stripe. Prices are listed in USD and are subject to change with 30 days' notice for existing customers.
All fees are non-refundable except as expressly stated in these Terms or as required by applicable law.
You agree not to use the Service to:
You retain all ownership rights to data you store or process using Supascale on your infrastructure. Supascale does not claim any ownership over your data.
Because Supascale runs on your infrastructure, we do not have access to your Supabase project data, databases, or storage files. Your data remains entirely under your control.
We do not use any customer data to train AI models, machine learning systems, or for any purpose other than providing the Service.
The Service and its original content, features, and functionality are owned by Supascale and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your license to use the software does not grant you any rights to our trademarks, service marks, or logos.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPASCALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR FIVE DOLLARS ($5).
You agree to defend, indemnify, and hold harmless Supascale and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Maine for the resolution of any disputes.
Before filing a claim, you agree to attempt to resolve disputes informally by contacting us. We will attempt to resolve the dispute informally by contacting you via email.
If informal resolution fails, any disputes shall be resolved through binding arbitration in Portland, Maine, in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
